SMS & Texting Consent Policy

1. Overview

Cavemen Landscapes ("we", "us", or "our") may send text messages (SMS/MMS) to clients and prospective clients who have provided their phone number and consented to receive text communications. This policy describes how we collect consent, the types of messages we send, and how to opt out, in compliance with Canada's Anti-Spam Legislation (CASL), the Canadian Radio-television and Telecommunications Commission (CRTC) Unsolicited Telecommunications Rules, and applicable provincial regulations.

2. Consent

2.1 How We Obtain Consent

We collect express consent to send text messages when you:

  • Submit your phone number through our website consultation form and check the opt-in box for text communications
  • Provide verbal consent during a phone call or in-person consultation (documented by our team)
  • Sign a service agreement that includes SMS communication authorization
  • Reply "YES" or "START" to an opt-in prompt from our number

2.2 Express vs. Implied Consent

Under CASL, we distinguish between express and implied consent:

  • Express Consent: You have affirmatively opted in to receive text messages. This consent does not expire unless you withdraw it.
  • Implied Consent: If you are an existing client, we may send transactional messages related to your active project (appointment confirmations, scheduling changes, project updates) under implied consent for up to 2 years after the completion of services.

3. Types of Messages

3.1 Transactional Messages

These messages relate directly to your service engagement:

  • Appointment confirmations and reminders
  • Scheduling changes or cancellations
  • Project milestone updates (e.g., "Materials delivered to your property today")
  • Weather-related delays or rescheduling
  • Invoice and payment confirmations
  • Post-project follow-ups and warranty information

3.2 Promotional Messages (Express Consent Required)

These messages are only sent with express opt-in consent:

  • Seasonal service reminders (e.g., spring clean-up, fall leaf removal, winter snow management)
  • Special offers or promotions
  • New service announcements
  • Event invitations or open-house notifications

4. Message Frequency and Costs

  • Transactional messages: Sent as needed based on your project schedule. Typically 1--5 messages per month during active projects.
  • Promotional messages: No more than 4 messages per month.
  • Costs: Message and data rates may apply depending on your mobile carrier and plan. Cavemen Landscapes does not charge for text messages, but your carrier may.

5. How to Opt Out

You may withdraw consent and stop receiving text messages at any time by:

Upon receiving your opt-out request, we will confirm unsubscription via a final text message and remove you from our SMS list within 2 business days. Opting out of promotional messages does not affect transactional messages related to an active service agreement.

7. Data Collection and Use

Your phone number and SMS consent status are stored securely in our systems. We do not sell, rent, or share your phone number with third parties for their marketing purposes. 8. Carrier Liability

Carriers (Rogers, Bell, Telus, etc.) are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.

9. Conditions

  • You must be 18 years of age or the age of majority in your province/territory to consent to receiving text messages.
  • By providing your phone number and consenting to SMS, you represent that you are the account holder or have authorization from the account holder.
  • Consent to receive text messages is not a condition of purchasing any goods or services from Cavemen Landscapes.

10. CASL Compliance Statement

All commercial electronic messages (CEMs) sent by Cavemen Landscapes comply with Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23. Each message includes:

  • Identification of Cavemen Landscapes as the sender
  • Our contact information (phone number and/or email)
  • A clear and simple unsubscribe mechanism (reply STOP)

Complaints regarding CASL compliance may be directed to the Canadian Radio-television and Telecommunications Commission (CRTC).

11. Changes to This Policy

We may update this SMS policy from time to time. Material changes will be communicated via text message to active subscribers and posted on this page.
